Welcome to EvalSports. These Terms of Service ("Terms") govern your access to and use of the EvalSports platform, including our website, mobile applications, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

By creating an account, accessing, or using EvalSports, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization (such as a soccer club, academy, or team), you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service after any modifications constitutes your acceptance of the updated Terms.

EvalSports is a comprehensive soccer analytics and player evaluation platform designed for soccer organizations, coaches, administrators, and parents. Our Service includes:

• Player evaluation and assessment tools
• Team management and organization features
• Performance analytics and reporting
• Training schedule management
• Communication tools (messaging, SMS, email)
• Event and attendance tracking
• Data visualization and insights

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you.

Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Account Types and Roles

EvalSports supports multiple user roles with different access levels:

• Club Administrators: Full access to organization settings, user management, and all data
• Coaches: Access to assigned teams, players, evaluations, and team management features
• Parents: Access to their child's evaluation data, team information, and communication features

You are responsible for ensuring that your account type and permissions are appropriate for your role within your organization.

SMS Verification

For security purposes, we require SMS verification during account setup and login. By providing your phone number, you consent to receive verification codes via SMS. Standard message and data rates may apply.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable local, state, national, or international law or regulation
• Infringe upon the rights of others, including intellectual property rights, privacy rights, or publicity rights
• Upload, post, or transmit any content that is harmful, abusive, defamatory, harassing, or discriminatory
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Use automated systems (bots, scrapers) to access the Service without our express written permission
• Interfere with or disrupt the Service or servers connected to the Service
• Reverse engineer, decompile, or disassemble any portion of the Service
• Use the Service to transmit viruses, malware, or other malicious code
• Collect or harvest information about other users without their consent
• Use the Service for any commercial purpose not authorized by your subscription plan

Violation of these terms may result in immediate termination of your account and legal action.

Your Content

You retain ownership of all content, data, and information you upload, post, or submit to the Service ("User Content"). By submitting User Content, you grant EvalSports a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service.

Player Data and Privacy

When you upload player information, evaluations, or other personal data, you represent and warrant that:

• You have the legal right and authority to collect and share such information
• You have obtained all necessary consents and permissions (including parental consent for minors)
• The information is accurate and up-to-date
• You comply with all applicable privacy laws, including COPPA for children under 13

Data Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of all User Content you submit. EvalSports does not endorse or assume responsibility for any User Content. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

Subscription Plans

EvalSports offers various subscription plans based on organization size and needs. Subscription fees, features, and limitations are detailed on our pricing page and may be updated from time to time.

Payment Terms

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law or as explicitly stated in your subscription agreement
• You are responsible for all taxes applicable to your subscription
• We reserve the right to change our pricing with 30 days' notice to existing subscribers

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting support.

Suspension and Termination

We reserve the right to suspend or terminate your account and access to the Service if:

• Payment is not received by the due date
• You violate these Terms
• You engage in fraudulent or illegal activity
• We determine, in our sole discretion, that your use of the Service poses a risk to us or other users

The Service, including its original content, features, functionality, design, logos, and trademarks, is owned by EvalSports and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service
• Use our trademarks, logos, or branding without our written permission
• Remove any copyright, trademark, or proprietary notices from the Service
• Use the Service to develop a competing product or service

We respect the intellectual property rights of others. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us using the information provided below.

Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We may experience downtime for maintenance, updates, or unforeseen circumstances.

No Professional Advice

The Service provides tools for player evaluation and analytics, but does not constitute professional coaching, medical, or legal advice. You should consult with qualified professionals for decisions regarding player development, health, or legal matters.

Limitation of Liability

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless EvalSports and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content
• Your failure to obtain necessary consents or permissions for data you submit

Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon termination, your access to the Service will cease immediately.

Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the Service or other users.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content, subject to our data retention policies and legal obligations. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, and indemnification.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last Updated" date
• Sending an email notification to registered users
• Displaying a prominent notice on our platform

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
